These Terms of Service ("Terms") govern your access to and use of the ScribbleSnap website at scribblesnap.ai and all related services (collectively, the "Service") operated by ScribbleSnap ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old to use ScribbleSnap. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. Description of Service

ScribbleSnap is an AI-powered coloring page generation service. Users can upload photographs and/or provide text prompts to generate custom coloring page images. The Service uses third-party artificial intelligence providers, including but not limited to OpenAI and Google Generative AI (Gemini), to process your inputs and generate images. These AI systems are operated by independent third parties and are not owned, controlled, or operated by ScribbleSnap.

3. Account Registration

To use certain features of the Service, you must create an account using Google OAuth or email/password authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Credit System and Payments

The Service operates on a credit-based system. New users receive a limited number of free credits. Additional credits may be purchased through our payment processor, Stripe, Inc. All purchases are final and non-refundable, except as required by applicable law. Credits do not expire. However, generated images are subject to retention limits (currently 30 days) and will be automatically deleted after the retention period.

We reserve the right to change pricing, credit amounts, and retention periods at any time. Changes will apply to future purchases and will not retroactively affect credits already purchased.

5. Third-Party AI Services — Acknowledgment and Assumption of Risk

By using ScribbleSnap, you expressly acknowledge and agree to the following:

• Your uploaded images and text prompts are transmitted to third-party AI servers operated by companies including OpenAI and Google. These servers are not owned or controlled by ScribbleSnap.
• Once your content is transmitted to these third-party servers, it is subject to their respective terms of service, privacy policies, and data handling practices. ScribbleSnap has no control over how these providers process, store, or use your data.
• ScribbleSnap is not responsible or liable for any actions taken by third-party AI providers with respect to your data, including but not limited to data retention, data breaches, content moderation decisions, or any other processing of your content.
• You assume all risk associated with transmitting your content to third-party AI providers through the Service.

6. AI Platform Content Policies — User Obligations

The third-party AI providers used by ScribbleSnap enforce their own content policies and acceptable use guidelines. You are required to comply with the content and usage policies of all underlying AI platforms, including but not limited to:

• OpenAI Usage Policies (openai.com/policies/usage-policies)
• Google Generative AI Prohibited Use Policy (policies.google.com/terms/generative-ai)

These policies generally prohibit content that is illegal, sexually explicit, violent, hateful, harassing, deceptive, or that infringes on the rights of others. Not all generation requests will succeed. If your prompt or uploaded image violates the content policies of the underlying AI provider, the request may be rejected, filtered, or modified. ScribbleSnap has no control over these automated content filtering decisions and is not responsible for any content that is rejected or flagged.

You are solely responsible for the content you upload and the prompts you submit. If your use of the Service results in a violation of any third-party AI provider's policies, you bear full responsibility for any consequences, including suspension or termination of access.

7. User Content and Intellectual Property

Your Uploads: You retain all ownership rights to images you upload to ScribbleSnap. By uploading content, you grant ScribbleSnap a limited, non-exclusive, worldwide, royalty-free license to process, transmit, and temporarily store your content solely for the purpose of providing the Service. This license terminates when your content is deleted from our servers. You represent and warrant that you own or have the necessary rights and permissions to upload and use all content you submit.

Generated Content: Generated coloring pages are provided to you for personal and commercial use. However, AI-generated content may not be eligible for copyright protection under current laws in various jurisdictions. ScribbleSnap makes no representations or warranties regarding the intellectual property status of AI-generated content. Any resemblance of generated images to existing copyrighted works, trademarks, or real persons is unintentional.

You are solely responsible for how you use, distribute, reproduce, or commercialize generated coloring pages. ScribbleSnap shall not be held liable for any claims arising from your use of generated content.

8. Prohibited Uses

You agree not to use the Service to:

• Upload or generate content that is illegal, obscene, pornographic, sexually explicit, defamatory, threatening, harassing, hateful, or that promotes violence or discrimination.
• Upload content that infringes on the intellectual property rights, privacy rights, publicity rights, or other rights of any third party.
• Upload or use copyrighted characters, trademarks, or other protected intellectual property owned by third parties (including but not limited to characters from film, television, animation, comics, video games, or other media) as inputs or prompts to generate coloring pages, unless you hold the necessary rights or licenses to do so.
• Upload images of minors for purposes other than creating age-appropriate coloring pages.
• Generate content that is not suitable for a family audience, including content depicting graphic violence, drug use, weapons used in a violent context, or any material that would not be appropriate for children.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated systems (bots, scrapers, etc.) to access or interact with the Service without prior written consent.
• Circumvent or attempt to circumvent any content filtering, rate limiting, or security measures.
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
• Violate any applicable local, state, national, or international law or regulation.

We reserve the right to suspend or terminate your account and refuse any current or future use of the Service if we determine, in our sole discretion, that you have violated these Terms. We also reserve the right to remove, disable, or restrict access to any specific content generated through the Service, without terminating your account, if we believe in our sole discretion that such content violates these Terms, applicable law, or the content policies of our third-party AI providers.

8A. Family-Safe Content Standard

ScribbleSnap is designed to produce coloring pages suitable for all ages, including children. All content generated through the Service is intended to meet a family-safe standard. You agree to use the Service only for purposes consistent with this standard. We reserve the right to reject, filter, or remove any content that we determine, in our sole discretion, does not meet this family-safe standard, regardless of whether such content otherwise violates the Prohibited Uses set forth in Section 8.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCRIBBLESNAP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WARRANTIES THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE FROM ERRORS.
• WARRANTIES THAT GENERATED CONTENT WILL NOT INFRINGE UPON THE INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES.

YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT IS PRODUCED BY AUTOMATED SYSTEMS AND MAY CONTAIN UNEXPECTED, INACCURATE, OR UNINTENDED RESULTS. YOU USE THE SERVICE AND ALL GENERATED CONTENT ENTIRELY AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• SCRIBBLESNAP'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO SCRIBBLESNAP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
• IN NO EVENT SHALL SCRIBBLESNAP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER SCRIBBLESNAP WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• SCRIBBLESNAP SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CLAIMS ARISING FROM: (A) YOUR USE OF OR RELIANCE ON GENERATED CONTENT; (B) THE ACTIONS, POLICIES, OR DATA HANDLING PRACTICES OF THIRD-PARTY AI PROVIDERS; (C) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR (D) ANY CONTENT YOU UPLOAD OR TRANSMIT THROUGH THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless ScribbleSnap, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees and legal costs) arising from or related to:

• Your access to or use of the Service.
• Your violation of these Terms or any applicable law or regulation.
• Your violation of any third-party right, including intellectual property, privacy, or proprietary rights.
• Content you upload, submit, or transmit through the Service.
• Your use, distribution, or commercialization of generated content.
• Any claim that your content or use of the Service caused damage to a third party.

This indemnification obligation will survive the termination of your account and these Terms.

12. Copyright Infringement and DMCA Policy

ScribbleSnap respects the intellectual property rights of others. If you believe that content generated through or hosted on the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing the following information in writing to our designated agent:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing, including sufficient information for us to locate it on the Service.
• Your contact information, including name, address, telephone number, and email address.
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid DMCA notification, we will promptly remove or disable access to the allegedly infringing content. We may also notify the user who generated the content. Repeat infringers may have their accounts terminated at our sole discretion.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination: (a) your right to use the Service will immediately cease; (b) any unused credits will be forfeited; and (c) we may delete your account data and generated images. You may delete your account at any time through the Service or by contacting us.

The following sections shall survive termination: Sections 5 (Third-Party AI Services), 7 (User Content), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 12 (DMCA Policy), 15 (Governing Law), and this Section 13.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. The "Last updated" date at the top of this page will be revised accordingly. Your continued use of the Service after any changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in the State of New Jersey. You consent to the personal jurisdiction and venue of such courts and waive any objections based on inconvenient forum.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy (available at scribblesnap.ai/privacy), constitute the entire agreement between you and ScribbleSnap regarding your use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and ScribbleSnap.
