ScribbleSnap ("we," "us," or "our") operates the website scribblesnap.ai (the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. By accessing or using ScribbleSnap, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

1. Information We Collect

a. Information You Provide Directly

• Account Information: Email address, name, and profile information obtained through Google OAuth sign-in.
• User Content: Photographs you upload, text prompts you enter, and any other content you submit to generate coloring pages.
• Payment Information: Billing details necessary to process purchases. Payment information is collected and processed directly by Stripe, Inc. We do not store your credit card numbers, bank account details, or other sensitive financial data on our servers.
• Communications: Any messages you send to us for support or feedback.

b. Information Collected Automatically

• Usage Data: Pages visited, features used, timestamps, click patterns, and referring URLs.
• Device Information: Browser type, operating system, device identifiers, screen resolution, and language preferences.
• Log Data: IP address, access times, and server logs.
• Cookies and Similar Technologies: Session cookies for authentication and functionality. See Section 10 for details.

2. How We Use Your Information

We use the information we collect for the following purposes:

3. Third-Party AI Processing — Important Disclosure

By using ScribbleSnap, you acknowledge and agree that your uploaded images and text prompts are transmitted to third-party artificial intelligence service providers for processing. These providers currently include, but are not limited to:

• OpenAI (openai.com)
• Google Generative AI / Gemini (ai.google)

When you submit content to ScribbleSnap, that content is sent to these third-party AI servers for the purpose of generating coloring page images. These AI servers are operated by independent third parties and are not owned, controlled, or operated by ScribbleSnap. Once your data is transmitted to these providers, it is subject to their respective privacy policies, terms of service, and data handling practices.

ScribbleSnap is not responsible or liable for how these third-party AI providers process, store, retain, or use your data once it is transmitted to their servers. We encourage you to review the privacy policies of these providers:

We may change, add, or remove third-party AI providers at any time without prior notice. The most current list of providers will be reflected in this Privacy Policy.

4. AI Content Policies — User Obligations

The third-party AI providers we use enforce their own content policies, usage policies, and acceptable use guidelines. By using ScribbleSnap, you agree to comply with the content and usage policies of all underlying AI platforms, including but not limited to:

• OpenAI Usage Policies (openai.com/policies/usage-policies)
• Google Generative AI Prohibited Use Policy (policies.google.com/terms/generative-ai)

These policies generally prohibit generating content that is illegal, harmful, sexually explicit, violent, hateful, deceptive, or that infringes on third-party rights. Not all requests will be processed successfully. If your prompt or uploaded image violates the content policies of the underlying AI provider, the request may be rejected, filtered, or modified by the AI provider. ScribbleSnap has no control over these content filtering decisions.

You are solely responsible for ensuring that the content you upload and the prompts you submit comply with all applicable laws and the content policies of the underlying AI platforms. ScribbleSnap is not liable for any content that is rejected, filtered, or flagged by third-party AI providers.

5. Other Third-Party Service Providers

In addition to AI providers, we use the following third-party services:

• Supabase: Authentication, database storage, and file storage. Your account data and generated images are stored on Supabase infrastructure.
• Stripe, Inc.: Payment processing. Stripe collects and processes your payment information in accordance with the Stripe Privacy Policy (stripe.com/privacy). We do not have access to your full payment card details.
• Upstash: Rate limiting and caching infrastructure.
• Vercel: Website hosting and deployment.

Each of these providers maintains their own privacy policies and security practices. We select providers that maintain industry-standard security measures, but we cannot guarantee the security practices of third-party services.

6. Data Retention and Deletion

• Generated Images: Stored for 30 days from the date of creation, then automatically and permanently deleted from our servers.
• Uploaded Photos: Processed for coloring page generation and not retained on our servers after processing is complete. However, uploaded photos are transmitted to third-party AI providers and are subject to their data retention policies.
• Account Data: Retained for as long as your account is active. Upon account deletion, your personal data will be removed within 30 days, except where retention is required by law.
• Payment Records: Transaction records are retained as required by applicable tax, accounting, and financial regulations.
• Usage and Log Data: Retained for up to 12 months for analytics and security purposes, then deleted or anonymized.

7. Data Security

We implement reasonable administrative, technical, and physical security measures to protect your personal information, including encryption in transit (TLS/SSL) and access controls. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee the absolute security of your data. Any transmission of personal information to us or through our Service is at your own risk.

8. Children's Privacy

ScribbleSnap is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use the Service or submit any personal information. If you are between the ages of 13 and 18, you may only use ScribbleSnap with the consent and supervision of a parent or legal guardian.

11. Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCRIBBLESNAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SCRIBBLESNAP DOES NOT WARRANT THAT GENERATED COLORING PAGES WILL NOT INFRINGE UPON THE INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES. AI-GENERATED CONTENT MAY NOT BE ELIGIBLE FOR COPYRIGHT PROTECTION UNDER CURRENT LAW. YOU USE GENERATED CONTENT AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRIBBLESNAP'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO SCRIBBLESNAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SCRIBBLESNAP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless ScribbleSnap, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of this Privacy Policy or our Terms of Service; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; (d) content you upload, submit, or transmit through the Service; or (e) your violation of any applicable law, rule, or regulation.

13. User Content and Ownership

You retain ownership of the images you upload to ScribbleSnap. By uploading content, you grant ScribbleSnap a limited, non-exclusive, worldwide, royalty-free license to process, transmit, and temporarily store your content solely for the purpose of providing the Service (i.e., generating coloring pages). This license terminates when your content is deleted from our servers.

Generated coloring pages are provided to you for your personal and commercial use. However, please note that AI-generated content may not be eligible for copyright protection in all jurisdictions. ScribbleSnap makes no representations or warranties regarding the intellectual property status of generated content. Any resemblance of generated images to existing copyrighted works, trademarks, or real persons is unintentional, and ScribbleSnap disclaims all liability for such resemblances.

You are solely responsible for how you use generated content. ScribbleSnap shall not be held liable for any claims arising from your use, distribution, reproduction, or commercialization of generated coloring pages.

14. Do Not Sell or Share My Personal Information

We do not sell your personal information to third parties. We do not share your personal information with third parties for their own direct marketing purposes. Your personal information is only shared with third-party service providers as described in this Privacy Policy, solely for the purpose of operating and providing the Service.

15. International Data Transfers

Your information may be transferred to and processed in countries other than the country in which you reside, including the United States. These countries may have data protection laws that differ from the laws of your country. By using the Service, you consent to the transfer of your information to the United States and other jurisdictions.
